    Terms of Service

    1. Acceptance of Terms

    Welcome to Skillium ("Skillium", "Skillium.ai", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our AI-powered quiz creation platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

    2. Definitions

    "User" means any individual using the Service. "Content" means quizzes and related materials generated, published, or uploaded by Users or the AI. "Plan" refers to the service tier attached to an account."Free Plan" refers to the plan available at no charge. "Pro Plan" refers to Skillium's paid monthly plan.

    3. Eligibility

    To use the Service, you must be at least 13 years of age. By using the Service, you represent and warrant that you are 13 or older.

    4. Account Registration

    You must create an account and provide accurate information, including your name and email. You are responsible for safeguarding your password and for all activity under your account.

    5. Subscription and Billing

    The Free Plan includes the monthly question allowance shown on our pricing and settings pages. The Pro Plan costs $14.99 per month unless the pricing page shows a different price before you subscribe. Applicable taxes may be added at checkout.

    Paid subscriptions renew automatically each month until canceled. By subscribing, you authorize Stripe to charge your selected payment method for the recurring price and applicable taxes. You can cancel from the billing portal. Cancel before the renewal date to prevent the next charge. After cancellation, paid access continues through the end of the current billing period unless the Service states otherwise.

    Payments are generally nonrefundable, except where required by law. We do not provide prorated refunds or credits for partial billing periods. We may change future prices after giving reasonable notice. A price change applies no earlier than a later renewal.

    The Pro Plan includes unlimited questions for normal individual study. It remains subject to fair-use and abuse safeguards. We may review, temporarily limit, or suspend use that indicates automated extraction, credential sharing, resale, interference with the Service, or use materially beyond normal individual study. We do not charge usage overage fees unless you separately agree to them.

    6. AI-Generated Content and Publishing

    All quizzes are generated by AI based on your inputs. You may publish quizzes to share publicly within the Skillium community. You retain ownership of your published Content but grant Skillium a worldwide, royalty-free license to host, display, and distribute it.

    AI-generated content may contain mistakes, omissions, or low-quality outputs. You are responsible for reviewing important academic content before relying on it or sharing it publicly.

    7. Usage Restrictions

    You agree not to:

    • Use the Service for any unlawful purpose or in violation of these Terms.
    • Cheat on any real-world examination using the Service.
    • Reverse engineer, decompile, or otherwise attempt to extract the source code.
    • Use automated systems to generate or extract content at a volume intended for resale or bulk reuse.
    • Share account access or evade usage, payment, security, or abuse safeguards.

    8. Data Collection and Privacy

    We collect personal data including name, email, billing information, quiz results, usage metrics, and location. Our collection and use of your data are governed by our Privacy Policy, available here.

    9. Intellectual Property

    All rights, title, and interest in the Service and Skillium™-branded materials are owned by Skillium.ai. A federal trademark application for Skillium is pending. You may not use our trademarks without prior written consent.

    10. Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. SKILLIUM DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY QUIZ CONTENT.

    11. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLIUM'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM.

    12. Governing Law

    These Terms and any disputes arising from them are governed by the laws of Minnesota, USA, without regard to conflict of law principles.

    13. Changes to Terms

    We may update these Terms from time to time. We will notify you of material changes via email or within the app. Continued use constitutes acceptance.
